21^st Century Travel Insurance TIPS Website Terms of Use

These Terms of Use (the "Terms") govern your use of the 21st Century Travel Insurance ("21st Century") Travel Insurance Processing System website ("TIPS" or "the Site"). 

BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

21st Century reserves the right to amend the content of the Site and all products and/or services provided through the Site at any time, with or without notice. 21st Century further reserves the right to amend the Terms at any time, with or without notice. Any changes to the Terms will be made available to you through the Site. By accessing the Site after the posting of changes to the Terms, you agree to be bound by such Terms, as amended.

1. Use of the Site

We granted you a limited, revocable, non-transferable and non-exclusive right to enter and use the Site. We may terminate your access at any time, with or without any reason.

21^st Century authorizes you to use the Site for convenience and for the purpose of transacting business with us.

As a condition of your use of the Site, you warrant to 21st Century that you will not use the Site for any purpose that is unlawful or prohibited by the Terms. You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site.

By accessing this Site, you agree to always act professionally when representing 21^st Century and to abide by the code(s) of conduct that govern insurance intermediaries as set out in each province where you are licensed.

2. Release and Waiver

By accessing the Site, you acknowledge that you are doing so voluntarily and with the understanding that 21^st Century and its partners, affiliates and employees are not providing you with medical, financial, legal or tax advice.

Any activities, goals, or other information presented to you through the Site are not substitutes for a medical professional's evaluation, diagnosis, and treatment.

 

3. Account, Password and Security

You agree that the information you provide to 21^st Century in connection with registering to use the Site and at all other times will be true, accurate, current and complete and will ensure that this information is kept accurate and up to date at all times. 

By using the Site, you agree to:

• Exercise appropriate care when using your 21^st Century login credentials to avoid theft, misappropriation, unauthorized access and unauthorized communication.
• Keep your 21st Century username and password confidential and not disclose them to anyone.
• Notify us immediately upon learning that your 21^st Century username and password has been disclosed or obtained by anyone else or may be known by anyone else, or that unauthorized use of the Site may by occurring with your login credentials.

You acknowledge and agree that your login credentials, including your 21^st Century username and password, and any Site pop-ups, prompts and edits, will constitute your electronic signature when you are transacting business or accessing the Site. You agree that:

• We may use your electronic signature as a means to authenticate you.
• Your electronic signature is the legal equivalent of your hand-written signature.
• You will carefully follow the Site pop-ups, prompts and edits.

4. Use of Credit Cards

You agree that when issuing policies in the Site, you will use your client's credit card to pay for the premium by:

• Entering the credit card information on the payment page of the Site, or
• Sending your client a secure payment processing link for the client to make payment.

You also agree to:

• Not record or retain client credit card information.
• Never receive or transmit client credit card information by email, messaging system or any other electronic means.
• Only obtain client credit card information for the sole means of charging the premium as displayed on the Site. 

You are not authorized to use your personal or corporate credit card to pay premium on behalf of your client.

5. Disclosure and Protection for Clients

You agree to safeguard and protect any personal information provided to you by your client to obtain travel insurance and to only disclose such information as required to generate the policy in the Site.

You agree to provide your client with a policy confirmation and policy wording(s) by electronic means and/or a printed copy. 

6. Privacy

21^st Century's Privacy policy applies to the use of the Site. To view our Privacy policy, click here. We shall adhere to applicable laws regarding privacy and the protection of personal information, and shall maintain appropriate administrative, technical and physical measures to safeguard and secure your personal information.

7. Disclaimer and Limitation of Liability

We provide the Site as a convenience to you on an "as available" basis and do not guarantee uninterrupted operation. 

We shall not be responsible or liable for any loss or damages you may suffer in connection with the Site, including any loss of access, reduced access, or unauthorized access to the Site, or in connection with your communications to 21^st Century through the Site and its replies via the same channels with the exception of breaches of privacy, confidentiality or security due to our negligence or breach of applicable law.

You use the Site at your own discretion and risk. We are not liable for any damages to the device or loss of data or information that results from your use of the Site. In no event will we, or our partners, affiliates, or employees, be liable to you or any other person for any harm or damages resulting from any use or misuse of the Site however so caused.

8. Records

In the absence of valid evidence of inaccuracy in 21^st Century's records, 21^st Century's records of your account are conclusive, and you agree to be bound by 21^st Century's records. In the event of a discrepancy between the information provided on the Site and 21^st Century's recordkeeping system, the information on 21^st Century's recordkeeping system will prevail. You always have the right to correct any inaccuracies in your personal information by contacting 21^st Century's Privacy Officer.
